O rastreamento por geolocaliza\u00e7\u00e3o foi feito para garantir que as marcas aderissem \u00e0s restri\u00e7\u00f5es.<\/p>\n\n\n\n<p>Enquanto uma licen\u00e7a de apostas federal custa R$ 30 milh\u00f5es (\u00a3 3,9 milh\u00f5es \/ \u20ac 4,7 milh\u00f5es \/ $ 4,8 milh\u00f5es) por cinco anos, a autoriza\u00e7\u00e3o da Loterj para o mesmo per\u00edodo \u00e9 de apenas R$ 5 milh\u00f5es. Al\u00e9m disso, a al\u00edquota para licenciados federais \u00e9 de 12% da receita bruta de jogos (GGR), significativamente maior do que os 5% cobrados sob uma licen\u00e7a da Loterj.<\/p>\n\n\n\n<p>Desde ent\u00e3o, a Loterj teve uma s\u00e9rie de <a href=\"https:\/\/igamingbusiness.com\/legal-compliance\/brazil-supreme-court-loterj\/\" target=\"_blank\" rel=\"noreferrer noopener\">recursos recusados<\/a>, que citavam a presen\u00e7a de \u201cdefeitos, omiss\u00f5es, obscuridades e erros materiais\u201d na decis\u00e3o. Ela afirmou que a tecnologia de rastreio por geolocaliza\u00e7\u00e3o n\u00e3o estava dispon\u00edvel para implementa\u00e7\u00e3o.<\/p>\n\n\n\n<p>No entanto, o IBJR pediu para ingressar no processo do STF como \u201camicus curiae\u201d, traduzido do latim como \u201camigo do tribunal\u201d, acreditando ter informa\u00e7\u00f5es relevantes para o processo.<\/p>\n\n\n\n<p>O IBJR diz que os licenciados da Loterj t\u00eam acesso \u00e0 tecnologia de rastreamento por geolocaliza\u00e7\u00e3o. A solicita\u00e7\u00e3o do \u00f3rg\u00e3o regulador estadual de uma prorroga\u00e7\u00e3o de 180 dias para o prazo inicial de cinco dias para habilitar a tecnologia \u00e9 desnecess\u00e1ria, afirma.<\/p>\n\n\n\n<p>O STF alertou que o descumprimento far\u00e1 com que a Loterj seja multada em R$ 500 mil por dia, enquanto as viola\u00e7\u00f5es continuarem.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-loterj-president-warns-of-unfair-competition\"><strong>Presidente da Loterj alerta para \u201cconcorr\u00eancia desleal\u201d<\/strong><\/h2>\n\n\n\n<p>O presidente da Loterj, Hazenclever Lopes Can\u00e7ado, <a href=\"https:\/\/igamingbusiness.com\/legal-compliance\/loterj-president-ban-brazil\/\" target=\"_blank\" rel=\"noreferrer noopener\">alertou anteriormente<\/a> que a proibi\u00e7\u00e3o do STF coloca em d\u00favida a estabilidade do rec\u00e9m-regulamentado mercado de apostas online no Brasil.<\/p>\n\n\n\n<p>\u201cA incerteza jur\u00eddica nas apostas brasileiras exp\u00f5e fraquezas legais, concorr\u00eancia desleal e burocracia que atrapalham o mercado e prejudicam a economia\u201d, escreveu Can\u00e7ado em um artigo para&nbsp;<a href=\"https:\/\/www.migalhas.com.br\/depeso\/422754\/bets-da-loterj-sao-vetadas-e-empresas-em-paraiso-fiscal-estao-isentas\" target=\"_blank\" rel=\"noreferrer noopener\">Migalhas<\/a>.<\/p>\n\n\n\n<p>\u201cA concorr\u00eancia desleal no mercado de apostas no Brasil assombra o empreendedorismo, enfraquece a economia nacional e conta com o apoio n\u00e3o apenas de operadores informais [ilegais], mas da pr\u00f3pria administra\u00e7\u00e3o p\u00fablica, que promove sistematicamente a inseguran\u00e7a jur\u00eddica e, assim, estimula a clandestinidade.\u201d<\/p>\n\n\n\n<p>A Loterj alega que seus licenciados pagaram mais de R$ 100 milh\u00f5es em impostos ao governo federal, e que essas contribui\u00e7\u00f5es est\u00e3o sob risco pela decis\u00e3o do STF, al\u00e9m de alertar para o potencial de empresas sediadas em para\u00edsos fiscais se beneficiarem.<\/p>\n\n\n\n<p>Can\u00e7ado explicou: \u201cA Uni\u00e3o, usando o criacionismo e sua pr\u00f3pria maldade, com o aval do judici\u00e1rio, proporciona um ambiente hostil \u00e0s apostas legalizadas, principalmente porque torna as regras mais r\u00edgidas para quem est\u00e1 no pa\u00eds.
