CDA Gaming wins injunction against Brazil’s MP 1.394 as Betsul, Casa de Apostas cleared to return
CDA Gaming Ltda has won an injunction allowing it to provisionally resume online betting operations in Brazil, after a federal appeals court suspended the effects of Provisional Measure (MP) 1.394 in relation to the company.
The ruling was handed down by Federal Appellate Judge Adriana Pileggi of the 3rd Panel of the Regional Federal Court of the 3rd Region (TRF-3). It means CDA’s three brands, Betsul, Casa de Apostas and Jogo Online, may return to the market until a final judgment is reached in the case.
MP 1.394 had prohibited betting operations, cutting short authorisations granted under Brazil’s regulated market. CDA Gaming received its licence from the Secretariat for Prizes and Betting (SPA) in February 2025, with SPA/MF Ordinance 255/2025 authorising it to operate all three brands.
Judge criticises MP’s justification
CDA challenged in court both the premature termination of its authorisation and the ban on operating in Brazil. Ruling in the company’s favour, Pileggi concluded that ending authorisations within such a short timeframe “causes harm to the authorised parties”, citing a disregard for the “constitutional principles of legal certainty, reasonableness and proportionality”.
The judge also took aim at the reasons given for MP 1.394, namely the protection of public health, consumers, children, adolescents and families.
“Well, if that were the case, this Provisional Measure would be a miracle – it would solve everything!” she wrote, adding that “obviously, such an approach is unacceptable from a legal standpoint”.
Pileggi ordered measures to restore the operational, financial and payment services the company needs to continue operating.
Brands slow to return
As of 4pm Brazilian time on Wednesday, 4 November (7pm UK), iGaming Business observed that only the Casa de Apostas website had come back online. Betsul’s site displayed a notice stating its operations had been restored under the court decision, but remaied non-functional. Jogo Online continued to redirect to the brasilsembets website.
